WINFIELD - A woman is suing Alpha Technologies Inc. for allegedly failing to pay her final wages in a timely manner.
Does 1 through 5 were also named as defendants in the suit.
On Nov. 30, Annitta Robinson's employment with Alpha was terminated while she was seeking tine off of work for a medical condition, according to a complaint filed May 21 in Putnam Circuit Court.
Robinson claims she did not receive her final paycheck until Dec. 3, which was more than 72 hours after termination.
Upon information and belief, Robinson was the only employee terminated and not subsequently rehired by Alpha after its purchase was completed, according to the suit.
Robinson claims the defendants violated the West Virginia Wage Payment and Collection Act.
Alpha's violation entitles Robinson to an award of treble damages and liquidated damages, according to the suit.
Robinson is seeking compensatory and punitive damages with pre-judgment interest. She is being represented by J. Patrick L. Stephens.
The case has been assigned to Circuit Judge Joseph K. Reeder.
