WINFIELD - A former employee claims Rite Aid of West Virginia Inc. failed to pay his final wages and fringe benefits when it terminated his employment.
Zachary Campbell was employed by Rite Aid and on Oct. 12, he was advised by Sherri Mullins and Marty Parlick that he was being suspended indefinitely with pay pending an investigation of an alleged harassment complaint, according to a complaint filed May 22 in Putnam Circuit Court.
Campbell claims he was scheduled to work 100 hours during the pay period of Oct. 7 and Oct. 20 and on Oct. 25, he was compensated for 80 hours through direct deposit for the pay period, resulting in a deficiency of 20 hours for that pay period.
On Oct. 31, Campbell was advised by Greg McClanahan, the Pharmacy District Manager, that his employment was terminated effective Nov. 1, according to the suit, and was told all compensation would be deposited, in addition to unused vacation time.
Campbell claims he has yet to receive pay for the 40 hours due for the week ending in Oct. 27, and never received his four weeks of vacation time.
The defendant violated the West Virginia Wage Payment and Collection Act, according to the suit.
Campbell is seeking judgment against Rite Aid for unpaid wages, fringe benefits and liquidated damages in the amount of $60,720 plus interest. He is being represented by Brian D. Yost of Holroyd & Yost.
