Woman says physicians failed to diagnose appendicitis

CHARLESTON - A woman who was injured when two physicians allegedly failed to diagnose appendicitis is suing them and U.S. Teleradiology LLC.

Drs. Maheep Goyal and Kenneth Dwyer were the physicians named as defendants in the suit.

Alexandria J. Kincaid presented to Montgomery General Hospital emergency department on Aug. 13 with acute abdominal pain and other symptoms and signs consistent with an abdominal complication and a CT scan was performed, according to a complaint filed June 6 in Kanawha Circuit Court.

Kincaid claims the defendants read and interpreted her CT scan and concluded that her appendix was normal and she was discharged from the hospital

The following day it was discovered that Kincaid's CT scan had been misread and she was contacted and advised to return to the emergency department, according to the suit.

Kincaid claims she opted to go to Charleston Area Medical Center instead of Montgomery and was diagnosed with appendicitis.

By the time Kincaid underwent surgery, she had an infection and abscess and was hospitalized until Aug. 29, according to the suit.

Kincaid claims as a result of the defendants' negligence, carelessness, recklessness and deviation from the applicable standard of medical care, she suffered a ruptured appendix, abscesses, infection, scarring and permanent injuries.

The defendants' negligence also caused Kincaid to incur medical expenses; endure pain and suffering; sustain a loss of household services; sustain impairment of the capacity to enjoy life; and suffer humiliation, embarrassment, annoyance, aggravation and mental anguish, according to the suit.

Kincaid is seeking compensatory damages. He is being represented by Tony L. O'Dell of Tiano O'Dell PLLC.

The case has been assigned to Circuit Judge Carrie Webster.
