Target settles slip-and-fall

CHARLESTON – Target Corporation has settled a slip-and-fall lawsuit filed against it in September.

Hope Beaver and husband Gerald filed a lawsuit against Target that alleged she slipped and fell in water that was carelessly and recklessly left in an aisle of the South Charleston Target.

On June 20, the sides filed an agreed order of dismissal that said the matter had been settled. Terms were not disclosed.

Mediation had taken place on May 31 with Frank Fragale serving as mediator.

Beaver claimed Target had a duty of reasonable care to protect its customers from defective or dangerous conditions existing on its premises which it knew or should have known existed.

As a result of the defendant’s negligence, Beaver received and sustained bodily injuries and incurred medical treatment and expenses, according to the suit.

Beaver claimed the defendant’s negligence caused her to become indebted for sums of money for hospitalization, drugs, medicines and other medical expenses.

Target’s actions also caused Beaver’s husband to be deprived of the services and consortium of his wife and has been required to perform duties that he would have had to perform if his wife had not been injured, according to the suit.

The Beavers were represented by Robert H. Miller of Romano & Associates of Charleston, while Target was represented by Rita Massie Biser of Moore & Biser in South Charleston.

The case was removed to U.S. District Court for the Southern District of West Virginia in September.
