CHARLESTON - A $30,000 settlement was reached in 2011 in a lawsuit against Southridge Grand Prix and Family Fun Center LLC.
A Financial Statement for Settlement for Nevaeh Miller, a minor, was filed on Nov. 8, 2011, in Kanawha Circuit Court.
An order approving the settlement was filed Sept. 7, 2011.
Kelly Watson sued Southridge after Miller, her daughter, was allegedly injured while riding go-carts.
On May 1, 2009, Miller was attempting to exit a go-cart she had been riding in when another go-cart collided with her and her go-cart, according to a complaint filed April 29, 2011, in Kanawha Circuit Court.
Watson claimed the employee assigned to operate and control the go-cart area was inattentive and failed to properly direct other children operating go-carts in order to prevent injuries.
The defendant’s negligence caused Miller severe and permanent injuries that have caused her to suffer a loss of the ability to carry out her normal daily activities and to enjoy life in general, according to the suit.
Watson was seeking compensatory damages with pre- and post-judgment interest. She was represented by Larry L. Rowe.
Southridge was represented by Bruce L. Freeman of Freeman & Chiartas and Adam B. Tomlinson of Steptoe & Johson.
The case was assigned to Circuit Judge Louis H. Bloom.
