CHARLESTON - Leslie Equipment Co. is suing Hi-Tech Construction Co. for allegedly failing to pay more than $10,000.
From approximately 2012 through the present, Hi-Tech entered into an equipment rental agreement with Leslie and the defendant agreed to pay for the rental of a machine, according to a complaint filed June 14 in Kanawha Circuit Court.
Leslie claims as of May 3, the defendant has incurred an account balance in the amount of $12,934.24.
Despite Leslie notifying Hi-Tech that it was in default on its account and incurring interest and collection costs, Hi-Tech has failed and refused to pay the amounts due and owing, according to the suit.
Leslie claims the defendant has been unjustly enriched because it has received the use and benefit of the equipment and parts from Leslie and has failed and refused to pay sums due and owing.
As a direct, proximate and foreseeable result of the defendant's breach of conduct and unjust enrichment, Leslie has incurred damages in the amount of at least $12,934.24, plus contractual pre- and post-judgment interest, according to the suit.
Leslie is seeking judgment in the amount of at least $12,934.24, plus continuing pre- and post-judgment interest. It is being represented by Jason S. Hammond and Betsy L. Stewart of Bailey & Wyant PLLC.
The case has been assigned to Circuit Judge Louis H. Bloom.
