CHARLESTON - Empire Electric Inc. is suing TL TEK for allegedly failing to pay more than $200,000 to it and another contractor after they were hired to perform work for TL TEK.
Teaming Partnership was also named as a defendant in the suit.
In February and March 2006, TL TEK entered into various contracts with Alan Ives Construction and Vista View Apartments for the construction of siding, roofing, gutters, drywall, stair landings and concrete generator pad in the total amount of $325,381.85, according to a complaint filed June 17 in Kanawha Circuit Court.
Harold Pannell and Empire Electric Inc. claim TL TEK contracted them to perform the construction work.
As a result of the understanding by and between the parties, the construction work was performed by the plaintiffs and they have not been properly paid for the work performed and for their expenses, according to the suit.
The plaintiffs claim they requested TL TEK provide them an accounting of all monies received from the Alan Ives Corporation and the breakdown of all expenses incurred in and during the projects, which TL TEK has failed and refused to do.
As a result of the defendants' breaches of agreements and understandings, the plaintiffs have suffered substantial financial harm, according to the suit.
The plaintiffs are seeking damages in the sum of $216,921.24 with interest. They are being represented by Charles E. Hurt.
The case has been assigned to Circuit Judge Louis H. Bloom.
