CHARLESTON - A lawsuit against Management & Training Corporation alleging discrimination was removed to federal court and then settled last year.
Beverly Williams, the director of Charleston Job Corps Center, which is under Management & Training Corporation, was also named as a defendant in the suit.
A Notice of Removal of the Civil Action to Federal Court was filed in Kanawha Circuit Court on Oct. 18, 2011.
On March 12, 2012, Tamara Eubanks and the defendants announced to the Court that the matter was resolved and both parties jointly moved the court to dismiss the case with prejudice with Rule 41(a) of the Federal Rules of Civil Procedure, according to the Agreed Order of Dismissal with Prejudice filed in the U.S. District Court for the Southern District of West Virginia at Charleston.
Eubanks, who is above the age of 40 and is African American, was employed by the defendants, according to a complaint filed May 2, 2011, in Kanawha Circuit Court.
Eubanks claimed her employment was terminated based on her age and race, which is in violation of the West Virginia Human Rights Act.
The defendants also created a hostile work environment, which made it impossible for Eubanks to perform her job duties, according to the suit.
Eubanks was seeking compensatory damages. She was represented by Shannon M. Bland of Bland & Bland Attorneys at Law LC.
The defendants were represented by Eric W. Iskra and Alyesha P. Asghar of Spilman Thomas & Battle PLLC.
The case was assigned to Circuit Judge Jennifer Bailey.
