Woman settles broken hip lawsuit against hair salon

CHARLESTON – A woman who alleged she tripped on uneven mats and broke her hip at LeGrand Hair Salon has settled her personal injury lawsuit.

Mildred McHenry filed her lawsuit Feb. 13 in Kanawha County Circuit Court against the salon, which removed it to U.S. District Court for the Southern District of West Virginia in May.

LeGrand removed the case on the grounds that it is an Ohio corporation, while McHenry is a West Virginia resident.

On July 12, the court entered an agreed order of dismissal that said all the matters in controversy had been resolved.

McHenry was represented by Cynthia E. Evans of Buffalo, while LeGrand was represented by P. Joseph Craycraft in Wheeling.

In her complaint, McHenry alleged on Feb. 12, 2010, she was a patron at the salon, which placed mats on the floor with ends that were not flush.

That allegedly made the surface uneven and caused McHenry to trip and fall. She allegedly suffered a broken hip and skinned elbow.

McHenry had to have surgery, rehabilitation and physical therapy, she said.
