Alpha Associates says RMJM owes nearly $150,000

CHARLESTON - Alpha Associates Inc. is sung RMJM Inc. for failing to pay nearly $150,000 for consulting service charges.

On Dec. 6, 2007, RMJM's predecessor-in-interest, The Hillier Group Architecture Pennsylvania Inc., entered into a contract with West Virginia University architectural and engineering services related to the Evansdale Redevelopment Site in Morgantown, according to a complaint filed June 26 in Kanawha Circuit Court.

On Dec. 6, 2010, the agreement was renewed until Dec. 5 and amended to reflect the change in vendor name and address to The Hillier Group doing business as RMJM, according to the suit.

Alpha claims on Aug. 16, 2011, it entered into an agreement with RMJM to provide architectural and other consulting services on a project.

Between Aug. 9, 2011, through March 5, 2012, Alpha invoiced RMJM for consulting service charges in the amount of $443,814.10, of which it has paid $296,969.65, leaving a balance of $146,844.45, plus interest.

To date, RMJM owes the principal amount of $146,844.45 for services rendered, plus interest charges in the amount of $47,031.63, totaling $193,876.08, according to the suit.

Alpha claims the defendant breached its contract and caused it to sustain damages.

The defendant has been unjustly enriched at Alpha's expense, according to the suit.

Alpha is seeking compensatory damages in the amount of $146,844.45, plus interest charges to be determined at the time of trial and post-judgment interest. It is being represented by Frank A. Oliverio of Hawkins Parnell Thackston & Young LLP.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
