Mardi Gras Casino sued, woman claims sidewalk uneven

WAYNE - A woman is suing Mardi Gras Casino for injuries allegedly sustained while at the casino.

On June 26, 2011, Joyce Simpkins was a guest at the Mardi Gras Casino as a customer, when she fell into the street as she stepped on the uneven/broken sidewalk and suffered injuries, according to a complaint filed June 26 in Wayne Circuit Court.

Simpkins claims the defendant owed a duty to exercise ordinary care to keep and maintain the premises of the casino in a reasonably safe condition.

The defendant was negligent and otherwise breached its duty owed to Simpkins by failing to exercise ordinary care to keep and maintain the premises of the casino; by failing to repair the uneven sidewalk in some manner; and by failing to warn Simpkins of the hazards presented by the condition, according to the suit.

Simpkins claims the defendant breached its duty owed to her.

As a result of the defendant's actions, Simpkins incurred medical expenses; has endured pain and mental suffering; and has suffered substantial annoyance, aggravation and inconvenience, according t the suit.

Simpkins is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Donald R. Jarrell.

The case has been assigned to Circuit Judge Darrell M. Pratt.
