CHARLESTON — A lawsuit against A Scooters & RV LLC and two of its employees for alleged ATV injuries was settled last year.
Dimitri Chaber and Ronnie Lee Prater were the employees named as defendants in the suit.
On July 6, 2012, a Dismissal Order was filed in Kanawha Circuit Court.
Adam Jay Meadows and the defendants announced to the court that all claims, demands and causes of action in the civil action had been compromised, agreed, settled and resolved and jointly moved to dismiss the matter with prejudice, according to the dismissal order.
On Sept. 8, 2009, Meadows went to the defendants to purchase an ATV, according to a complaint filed May 20, 2011, in Kanawha Circuit Court.
Meadows claims Prater offered for him to ride on an ATV with him, so he agreed to.
Prater then began to operate the ATV in a negligent and/or reckless manner, causing it to flip over and land on Meadows’ leg, according to the suit.
Meadows claims Chaber and A Scooters & RV were not properly supervising Prater.
The defendants also failed to provide necessary and appropriate training to its employees, according to the suit.
Meadows was seeking compensatory and punitive damages with pre- and post-judgment interest. He was being represented by Robert D. Cline Jr., Robert A. Campbell, R. Chad Duffield and Eric M. Hayhurst of Farmer, Cline & Campbell PLLC.
A Scooters & RV and Chaber were represented by Joshua K. Boggs of Mintzer, Sarowitz, Zeris, Ledva & Meyers LLP. Prater was represented by Daniel R. Schuda of Schuda & Associates PLLC.
The case was assigned to Circuit Judge Louis H. Bloom.
