HUNTINGTON - A man is suing his former attorney and the attorney's law office after he claims they negligently failed to file his claims in a timely manner.
R. Stephen Jarrell-Attorney at Law and R. Stephen Jarrell were named as defendants in the suit.
Samuel Lee Carroll entered into an attorney-client relationship in March 2006, when he retained the defendants to represent him in both a medical malpractice claim and a wrongful termination claim, according to a complaint filed July 29 in Cabell Circuit Court.
Carroll claims the defendants had an opportunity to file the claims from March 2006 until March 2013, when he discovered they were negligent in doing so.
The defendants neglected a reasonable duty to file complaints within the statute of limitations and their failure to file the complaints in the actions was the proximate cause of the inability of the plaintiff to move forward with his lawsuits for medical malpractice and wrongful termination, according to the suit.
Carroll claims he suffered a monetary loss resulting from the defendant's failure to file the lawsuits for which the defendants were retained to prosecute.
