CHARLESTON - A Mason County couple are suing Charleston Newspaper Holdings LP for injuries allegedly sustained from a car accident.
Daily Gazette Company, Angela R. Boyd and David K. Boyd were also named as defendants in the suit.
On Aug. 1, 2011, Charles J. Mullens and Kelly L. Mullens were lawfully traveling east on Pond Road in Mason County when they encountered Angela Boyd, who then lost control of her vehicle, crossed the center line and collided with the Mullens' vehicle, according to a complaint filed July 18 in Kanawha Circuit Court.
The Mullenses claim Angela Boyd was delivering newspapers in Mason County area for her husband, David Boyd, who was incarcerated at a local jail at the time and unable to complete his daily route, in a 2008 Hyundai Accent that they co-owned.
Angela Boyd was issued citations for failure to maintain control and not having insurance by a sergeant of the Mason County Sheriff's Department, according to the suit.
The Mullenses claim they suffered physical injuries, mental anguish, emotional stress, annoyance, inconvenience, impairment of the capacity to enjoy life and other injuries.
The defendants are liable for all damages and injuries proximately caused by Angela Boyd's negligent driving, according to the suit.
The plaintiffs are seeking compensatory and punitive damages. They are being represented by Bernard E. Layne III of Mani, Ellis & Layne PLLC.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
