Man says ABM Janitorial Services-Mid Atlantic failed to timely pay wages

CHARLESTON - A former employee is suing ABM Janitorial Services-Mid Atlantic Inc. for failing to timely pay his final wages.

Joel M. Querry was employed by the defendant as a cleaner until May 29, according to a complaint filed July 19 in Kanawha Circuit Court.

Querry claims the defendant failed to pay his final wages in a timely manner.

The defendant had a duty pursuant to the West Virginia Wage Payment and Collection Act to pay Querry's final wages within 72 hours of discharge and failed to do so, according to the suit.

Querry claims the defendant breached its duty by failing to pay his final wages until June 13.

The defendant's actions caused Querry damages and were a violation of West Virginia code, according to the suit.

Querry is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess and Joy B. Mega of Bailess Law.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
