Providence Enterprises sued over final wages of truck driver

CHARLESTON - A former employee is suing Providence Enterprises LLC for allegedly failing to timely pay his final wages.

Lance Presley was employed as a truck driver for the defendant until March 15, 2012, according to a complaint filed July 19 in Kanawha Circuit Court.

Presley claims he did not receive his final wages in a timely manner.

On March 20, 2012, the defendant informed Presley via text message that he would not receive his final check until he returned his work uniform, according to the suit.

Presley claims the defendants failed to timely pay his final wages violated the West Virginia Wage Payment and Collection Act.

The defendant's conduct caused Presley damages and entitles her to treble damages, according to the suit.

Presley is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess and Joy B. Mega of Bailess Law.

The case has been assigned to Circuit Judge Louis H. Bloom.
