CHARLESTON - A woman is suing Volkswagen of America Inc. after she claims the vehicle she purchased was defective.
On March 27, 2010, Cynthia Coleman purchased a used 2008 Volkswagen Eos, according to a complaint filed July 26 in Kanawha Circuit Court.
Coleman claims after purchasing the used motor vehicle, she experienced repeated nonconformities with the vehicle, which substantially impaired the use and market value of the vehicle.
After a reasonable number of attempts to do so, the manufacturer did not conform the vehicle to the warranty, nor replace it with a comparable used vehicle which did conform to the warranties, according to the suit.
Coleman claims as a result of the defendant's failure, she was caused damage by the law of use of the vehicle, annoyance and inconvenience and incurred expenses for replacement transportation,
The defendant failed to give Coleman notice required by West Virginia code and the defendant engaged in a course of repeated and willful violation of its obligations under West Virginia code, according to the suit.
Coleman is seeking compensatory damages. She is being represented by Anthony M. Salvatore.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
