* Nibert worked for Chapman-Martin Excavation & Grading Inc. Chapman and Hinkle were the principal stockholders of Chapman-Martin. On Aug. 20 Chapman-Martin discontinued business and filed bankruptcy. Nibert claims the defendants are liable for all wages, fringe benefits and liquidated damages owed to him under the West Virginia Wage Payment and Collection Act. Nibert is seeking compensatory damages with pre- and post-judgment interest.
