WAYNE - A former Chapman-Martin Excavation & Grading Inc. employee is suing the two principal shareholders for fringe benefits and wages.
John C. Nibert worked for Chapman-Martin Excavation & Grading Inc., according to a complaint filed Aug. 7 in Wayne Circuit Court.
Nibert claims Aletta Chapman and James Brian Hinkle were the principal stockholders of Chapman-Martin.
On Aug. 20 Chapman-Martin discontinued business and filed bankruptcy, according to the suit.
Nibert claims the defendants are liable for all wages, fringe benefits and liquidated damages owed to him under the West Virginia Wage Payment and Collection Act.
Nibert is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Lawrence B. Lowry of Barrett Chafin Lowry & Amos.
The case has been assigned to Circuit Judge Darrell Pratt.
