CHARLESTON - A former employee is suing Sun Energy Services LLC for allegedly discriminating against him based on his age.
Sun Energy Services is also known as Deep Well Services.
Tracy J. Weekley, an employee of Sun Energy, was also named as a defendant in the suit.
Edward H. Burrows Jr. was employed by Sun Energy from January 2009 until Jan. 17, according to a complaint filed July 29 in Kanawha Circuit Court.
Burrows claims the defendants discriminated against him based on his age and violated the West Virginia Human Rights Act.
Sun Energy was prohibited from discriminating in employment termination decision on the basis of age, according to the suit.
Burrows claims Weekley made a comment to him about his age and said he was going to buy him a rocking chair.
The defendants also failed to pay all of Burrows' wages due to him in a timely manner, which violated the West Virginia Wage Payment and Collection Act, according to the suit.
Burrows is seeking compensatory and punitive damages. He is being represented by David M. Goldenberg and Robert T. Goldenberg of the Goldenberg Law Firm PLLC.
The case has been assigned to Circuit Judge Louis H. Bloom.
