CLARKSBURG - Photocraft LLC is suing C. Harper Holdings Inc. for allegedly breaching its contract and causing monetary damages.
C. Harper Holdings Inc. is doing business as C. Harper Auto Group, C. Harper Chevrolet the Price Fighter, C. Harper Chevrolet Inc., C. Harper Chevrolet-Geo-Buick Inc., C. Harper Ford, Kia, C. Harper Honda, C. Harper Kia and C. Harper Subaru.
On Nov. 19, Photocraft and C. Harper executed an agreement in which Photocraft would provide advertising for C. Harper for 52 consecutive publications at $815 per advertisement and a total of $42,380, according to a complaint filed Aug. 13 in the U.S. District Court for the Northern District of West Virginia at Clarksburg.
Photocraft claims C. Harper ceased making payments on Feb. 7, as required under the agreement and on Feb. 22, through its attorney, C. Harper notified Photocraft of its intent to breach the agreement.
C. Harper paid approximately $7,221.04 pursuant to the agreement and owes approximately $34,158.96, according to the suit.
Photocraft claims among C. Harper's reasons for breaching the agreement was that Robert Charles, who agreed to the agreement, did not have the authority to do so and that he was no longer an employee of C. Harper.
C. Harper's breach of agreement has caused Photocraft to sustain damages, according to the suit.
Photocraft claims C. Harper's breach of agreement by failing to make payments under the agreement has resulted in significant monetary damages, which continue to accrue.
Photocraft is seeking compensatory damages. It is being represented by Andrew G. Fusco and Dylan C. Lewis of Bowles Rice LLP.
