CHARLESTON - A woman is suing St. Francis Hospital Inc. for allegedly causing her injuries by failing to keep the pavement in repair.
On Aug. 10, 2011, Alice Kyer was at Saint Francis when she slipped and fell on an uneven sidewalk, according to a complaint filed Aug. 8 in Kanawha Circuit Court.
Kyer claims when she fell she landed face first into the ground, causing her to suffer a broken nose, fractured shoulder and various cuts to her face.
The defendant failed to keep the pavement in a safe condition due to carelessness and negligence, according to the suit.
Kyer claims the defendant owed her a duty of reasonable care and failed to perform that duty.
As a direct and proximate result of the defendant's negligence, Kyer sustained serious and permanent injuries and was caused to expend great sums of money for medical care and attention, according to the suit.
Kyer is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Kevin C. Harris and Eric J. Holmes.
The case has been assigned to James C. Stucky.
