HUNTINGTON - A man is suing Huntington Housing Corporation for injuries allegedly caused to his foot by tiny metal shavings.
Huntington Housing Corporation is doing business as the Huntington West Virginia Housing Authority.
On Aug. 25, 2011, maintenance personnel employed by the defendant were working on the door of Carlos Crozier's apartment, according to a complaint filed Aug. 20 in Cabell Circuit Court.
Crozier claims rather than replacing the door, the maintenance personnel grinding the side of the door and left metal shavings in the entryway of the apartment.
When Crozier returned home, he was unaware of the metal shavings, some of which became embedded in his left foot and heel, according to the suit.
Crozier claims he was not given advanced notice that work was to be performed on his apartment that day.
The defendant failed to exercise a reasonable and proper degree of care and prudence in its maintenance of the property and failed to clean up the metal shavings to prevent injury to the occupant of the public housing unit, according to the suit.
Crozier claims the defendant owed him a duty to maintain the public housing unit in a safe, prudent and lawful manner and give due regard to any unreasonable risks which might occur.
As a direct and proximate result of the negligent, careless and unlawful acts of the defendant, Crozier suffered injuries and damages, according to the suit.
Crozier is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Lynn Garnes.
The case has been assigned to Circuit Judge David M. Pancake.
