HUNTINGTON - A woman is suing the City of Huntington after she claims she tripped and fell due to a concrete sidewalk that had fallen into disrepair.
On Aug. 31, 2012, Rhonda Carter was walking along a sidewalk of Ninth Avenue in Huntington when she stumbled and fell due to an unseen rise in the concrete of the sidewalk, according to a complaint filed Aug. 22 in Cabell Circuit Court.
Carter claims the defendant failed to maintain the sidewalk in a reasonably safe condition and allowed a rise of at least one-half inch to exist and failed to warn her of the danger presented by the rise in the concrete on the sidewalk.
The defendant failed to maintain the sidewalk in a manner which allowed the sidewalk to remain flush with the rest of the sidewalk and failed to otherwise exercise due care, according to the suit.
Carter claims as a result of the negligence of the defendant, she stumbled on the sidewalk while attempting to walk on the sidewalk.
Carter is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Jon D. Hoover of Hoover Andrews PLLC.
The case has been assigned to Circuit Judge F. Jane Hustead.
