Lawsuit against Charleston surgeon dismissed

Shuman

CHARLESTON - A lawsuit against a Charleston surgeon has been dismissed from Kanawha Circuit Court.

On Feb. 8, the lawsuit filed by Tammy D. McCormick on May 20, 2011, was dismissed after McCormick informed the court she wished to voluntarily dismiss her claim.

On March 25, 2009, McCormick underwent a laparoscopic assisted vaginal hysterectomy, right peritubal cystectomy, bi-lateral salpingo-oophorectomy and cystotomy with cystotomy repair, which was performed by Dr. Dara Porfeli Aliff, according to a complaint filed May 20, 2011, in Kanawha Circuit Court.

McCormick claimed when she woke up from the surgery, Aliff informed her that she had cut her bladder during the surgery, but that the laceration had been repaired during the surgery.

After the surgery, McCormick continued to follow up with Aliff and advised her that she was experiencing urinary inconsistence, which she still continues to experience, according to the suit.

McCormick claimed Aliff negligently cared for her during the surgery and failed to perform the surgery.

McCormick was seeking compensatory damages with pre- and post-judgment interest. She was being represented by Charles M. Johnstone and Sarah A. Stewart of Johnstone & Gabhart LLP.

The defendant was represented by David L. Shuman of Shuman, McCuskey & Slicer PLLC.

The case was assigned to Circuit Judge Paul Zakaib Jr.
