PNC Bank sued over loan

NEW CUMBERLAND - A Newell man is suing over claims a bank breached the terms of a loan contract.

Hancock County resident Donald D. Spencer Sr. filed a lawsuit on July 12 in the Circuit Court of Hancock County, against PNC Bank, NA, citing negligence.

Spencer says he was a co-signer on a loan agreement in January 2012, and the bank failed to notify him when the third party ceased making required payments and the agreement went into default.

The bank also failed to inform the plaintiff of repossession of an automobile used as collateral, and also failed to provide other documents and notices as required by law, according to the complaint.

Spencer claims he sustained damage to his credit rating as well as loss of income and other damages, and he is seeking an undetermined amount of relief.

He is being represented by Weirton attorney M. Eric Frankovitch.
