Student can't join military because of fall, lawsuit says

ROMNEY - A Springfield student and his parents are suing the Hampshire County Schools Board of Education following a fall from a ladder during class.

Sean Martin Brown, Clara Brown and David Brown filed a lawsuit on Feb. 25 on behalf of their minor son in the Circuit Court of Hampshire County against Hampshire County Schools BOE, citing carelessness and negligence.

The plaintiffs say Sean was permanently injured after he fell from an unsecured ladder on top of a hay wagon on Oct. 22, 2009, when he and a teacher were working outside the county high school's agricultural facility during an agricultural class.

His medical expenses have cost a total of $19,628.86, and he no longer can pursue his dreams of joining the military because of his ankle injuries, according to the complaint.

The plaintiffs are seeking an undetermined amount of relief.

They are being represented by Keyser attorney James E. Smith.
