WAYNE - Eight women are suing Maintream Services Inc. for allegedly violating the West Virginia Wage Payment and Collection Act and causing them damages.
Ashley Messinger, Tasha Willis, Megan Sparks, Clara Damron-Miller, Debbie Spence, Erica Hardesty, Ashley Pridemore and Ashley Plumley were employed by Mainstream Services until their involuntary terminations on April 12, according to a complaint filed Aug. 21 in Wayne Circuit Court.
The plaintiffs claim Mainstream failed to pay them all wages due within 72 hours of discharge.
Mainstream did not pay the plaintiffs their employment wages until April 19 and May 3, according to the suit.
The plaintiffs claim the defendant's actions violated the West Virginia Wage Payment and Collection Act and caused them damages.
All persons formerly employed by Mainstream at any time in the five years prior to filing of the plaintiffs' complaint through class certification in West Virginia who were discharged and not paid all wages within 72 hours of their discharge are part of the putative class in the complaint, according to the suit.
The plaintiffs are seeking compensatory damages. They are being represented by Todd S. Bailess and Joy B. Mega of Bailess Law PLLC and J. Kristofer Cormany of Cormany Law PLLC.
The case has been assigned to Circuit Judge Darrell Pratt.
