Chair broke while man was sitting in it, lawsuit claims

PRINCETON - A man is suing a Bluefield business after allegedly being injured while sitting in a chair.

Plaintiff Mitchell Mesiemore filed suit on June 25 against Variety Stores Inc. for injuries sustained when he fell after the leg on the chair he was sitting on snapped.

On or about June 29, 2011, the plaintiff was in the Variety Store at Mercer Mall in Bluefield, he says.

Mesiemore allegedly suffered injury when the back leg broke off of the plastic chair he was sitting on. Mesiemore alleges that the store knew of the dangerous condition on its premises but failed to correct it or warn customers.

The plaintiff claims that he suffered injuries to his back, arm and leg, causing physical and mental pain and suffering, according to the brief.

Mesiemore seeks compensatory damages and attorney fees. He is represented by William J. Akers of Akers Law Office.
