Man says Standard Distributing violated wage payment act

CHARLESTON - A man is suing Standard Distributing Inc. for allegedly violating the West Virginia Wage Payment and Collection Act by failing to timely pay his final wages.

Robert Person was also named as a defendant in the suit.

Hal L. Thurmond was employed by Standard as a delivery driver until May 10, according to a complaint filed Aug. 22 in Kanawha Circuit Court.

Thurmond claims the defendants had a duty to pay his final wages within 72 hours and failed to do so.

Person, acting in his capacity as an officer of Standard, knowingly permitted Standard to violate the West Virginia Wage Payment and Collection Act, according to the suit.

Thurmond claims he did not receive his final wages until on or after May 15.

The defendant's actions in violating the West Virginia Wage Payment and Collection Act entitles Thurmond to treble damages, according to the suit.

Thurmond is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess and Joy B. Mega of Bailess Law PLLC.

The case has been assigned to Circuit Judge Jennifer Bailey.
