Skier hits tree stump, breaks leg, files lawsuit

MARLINTON - Snowshoe Mountain is being sued over claims that unsafe conditions on a ski trail caused the plaintiff serious injury.

Wesley D. Pryor filed a lawsuit Jan. 4 in the Circuit Court of Pocahontas County against Snowshoe Mountain Inc., citing negligence.

Pryor says on Jan. 7, 2011, he suffered a serious leg fracture when he struck a tree stump while snowboarding at Snowshoe Mountain, located in Snowshoe.

The complaint states the accident happened when the plaintiff proceeded down a splinter trail that was not marked as closed or not a trail.

On the splinter trail, there were at least two tree stumps about two feet high, according to the complaint. Pryor states that he had no warning of the tree stumps and could not avoid striking one.

The plaintiff says he has incurred expenses exceeding $100,000 and is seeking an undisclosed amount in damages. He is being represented by Lewisburg attorneys Barry L. Bruce, Christine Stump and Jesseca Church of Barry L. Bruce & Associates LC.
