HUNTINGTON - A couple are suing The Ridges at Twin Silos LLC and its owner for an alleged breach of contract in constructing their home.
Gregory D. Hatfield is doing business as The Ridges at Twin Silos LLC.
On Feb. 17, the defendants were contracted by Travis Cassell and Melissa Cassell to build a new home in Culloden, according to a complaint filed Sept. 6 in Cabell Circuit Court.
The Cassells claim the contract signed was a pre-printed form supplied by the defendants and on March 12, the plaintiffs moved into the home.
On Aug. 1, the Cassells discovered the home was carelessly, recklessly, negligently and intentionally constructed in a poor manner, according to the suit.
The Cassells claim unbeknownst to them, Hatfield's contractor's license expired in March.
As a direct and proximate result of the carelessness, recklessness, negligence and intentional acts of the defendants, the Cassells have sustained personal debt of a serious nature, including remodeling expenses, reconstruction expenses and repair expenses to the home, according to the suit.
The Cassells claim they have sustained out-of-pocket expenses to have the home inspected and have specialists remove mold and dangerous air spores from the home.
The defendants breached their duties of good faith and fair dealing, according to the suit.
The Cassells are seeking compensatory and punitive damages. They are being represented by Maggie K. Wall and G. Wayne Van Bibber of the Law Offices of G. Wayne Van Bibber & Associates.
The case has been assigned to Circuit Judge David M. Pancake.
