MARLINTON - A tree-trimmer is suing his employer after an alleged fall resulted in broken wrist.
Robert Waid and Kimberly Waid filed a lawsuit June 13 against Richard A. Jordan Logging Co. in the Circuit Court of Pocahontas County, citing deliberate intent and loss of consortium.
Robert Waid says that he was employed by Richard Jordan Logging as a tree-trimmer and timber-cutter. On Dec. 8, 2011, Waid was limbing hemlocks in Nicholas County.
According to the complaint, Richard Jordan cut down and stacked the hemlocks over a creek bed which resulted in the trees being 10 to 15 feet off the ground.
Waid alleges he asked to have the trees moved to a safer area, but was ordered to limb the trees over the creek bed and as a result he fell and broke his left wrist.
The Waids are seeking an undisclosed amount in damages. They are being represented by Buckeye attorney Roger D. Forman of The Law Offices of Roger D. Forman L.C.
