HUNTINGTON - A woman is suing Building Discount LLC for alleged unjust enrichment and breach of contract that caused her damages.
Carolyn Cooper entered into a contract where the defendant agreed to provide services in remodeling her kitchen, including installation of flooring, a window, cabinets, appliances and utilities, according to a complaint filed Sept. 4 in Cabell Circuit Court.
Cooper claims the defendant submitted an estimate of $12,786.29 for labor, materials and equipment to complete the work, and she paid approximately $9,000 to the defendant.
The project commenced in March 2012 and continued through April 2012, according to the suit.
Cooper claims the work contracted for was not completed and after April 2012, no more work was performed by the defendant.
The defendant negligently performed work, resulting in damages to Cooper, according to the suit.
Cooper claims the defendant installed the electrical wiring gas lines in violation of the law, resulting in damages.
The defendant has been unjustly enriched by the payment of money by Cooper to the defendant, according to the suit.
Cooper is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Rachael S. Carrico of Carrico Law Offices LC.
The case has been assigned to Circuit Judge David M. Pancake.
