Woman sues Frontier West Virginia, alleges wage payment violations

CHARLESTON - A former employee is suing Frontier West Virginia Inc. for allegedly failing to timely pay her final wages.

Marci Woodson was employed by the defendant from November 2000 until Oct. 5, 2012, according to a complaint filed Aug. 28 in Kanawha Circuit Court.

Woodson claims when she did not receive her final paycheck, she contacted the defendant and the defendant subsequently forwarded her final paycheck to her by mail.

In forwarding her final paycheck, the defendant failed and refused to pay Woodson her final wages within 72 hours, as required by the West Virginia Wage Payment and Collection Act, according to the suit.

Woodson claims the defendant violated West Virginia Code and caused her damages.

As a direct and proximate result of the defendant's illegal conduct, Woodson has incurred lost income, according to the suit.

Woodson is seeking compensatory and punitive damages with pre-judgment interest. She is being represented by Richard W. Walters of Shaffer & Shaffer PLLC.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
