Toyota kept calling couple, lawsuit alleges

RALEIGH - A Lincoln County couple are alleging debt collection calls continued after advising the company they retained an attorney.

Dempsey Lacy and Linda Sue Lacy filed a lawsuit Jan. 7, against Toyota Motor Credit Corporation in Raleigh County Circuit Court, citing violations of the West Virginia Consumer Credit and Protection Act, negligence, intentional infliction of emotional distress and invasion of privacy.

The Lacys say they were indebted to Toyota and hired a lawyer to represent them regarding their debts.

According to the complaint, Toyota began calling the Lacys in an attempt to begin collection efforts. The Lacys allege they informed Toyota they had hired counsel and provided the lawyer's name and telephone number to Toyota.

The complaint alleges that Toyota continued to call the Lacys after being advised of their representation by counsel.

The Lacys are seeking an undisclosed amount of damages including punitive damages and court costs. They are being represented in the case by Beckley attorney Paul W. Roop II of Roop Law Office LC and Charleston attorney Robin L. Godfrey.
