CLARKSBURG - A Delaware chemicals company is suing over claims a steelworkers union group is attempting to modify a collective bargaining agreement between the parties.
Cytec Industries Inc. filed a lawsuit on Sept. 13 in U.S. District Court for the Northern District of West Virginia in Clarksburg against the United Steelworkers International Union, Local 499.
The plaintiff claims the defendant submitted an Aug. 22 grievance report to the plaintiff on behalf of a former Cytec hourly worker who was unable to rescind his letter of resignation. Cytec claims the matter cannot be submitted for arbitration, as the defendant requested.
Cytec is seeking a declaratory judgment declaring that these issues are not arbitrable under the collective bargaining agreement.
The company is being represented by Charleston attorney Ellen J. Vance of Spilman, Thomas & Battle in Charleston.
