BECKLEY - A Raleigh County man is suing his employer, alleging malicious prosecution.
Danny Freeman filed a lawsuit Jan. 7 against Alpha Natural Resource Service LLC, Jason Bussey and Shawn Belcher in the Circuit Court of Raleigh County, citing malicious prosecution.
Freeman says that on March 26, 2012, he was told to leave his post at the mines and come to the surface to be searched and drug tested. According to the complaint, at the same time Shawn Belcher contacted the West Virginia State Police officers who issued Freeman a ticket for having medicine on the premises.
Freeman alleges he and his vehicle were searched and he was suspended for five days. He says that he met with Alpha Resources the following day to provide information regarding the medication, at which time he was place on indefinite suspension.
On Oct. 22, 2012, Freeman says he appeared in court at which time his ticket was dropped.
Freeman is seeking an undisclosed amount of damages. He is being represented in the case by attorney Anthony M. Salvatore of Hewitt & Salvatore.
