BECKLEY - A man is suing General Motors after his new vehicle allegedly failed to conform to new vehicle warranties.
Kevin Paynter filed a lawsuit Jan. 28 against General Motors LLC in the Circuit Court of Raleigh County, seeking revocation of acceptance of a motor vehicle.
Paynter says that on Nov. 4, 2010, he purchased a new 2010 Buick Lacrosse from a dealership for $28,3887.62.
He alleges that after the purchase, he experienced repeated non-conformities with the new vehicle warranty that substantially impaired the use and market value of the vehicle.
According to the complaint, after a reasonable number of attempts, the manufacturer did not conform the new vehicle to the warranty nor replace it with a conforming new comparable vehicle.
Paynter is seeking damages including revocation of acceptance and refund of the purchase price, loss of use, cost of repairs and attorneys fees. He is being represented in the case by Anthony M. Salvatore of Hewitt & Salvatore PLLC.
