FAYETTEVILLE - A consulting firm is suing for alleged breach of contract and seeking compensation for services rendered to Roaring Rivers Community Association.
EK & Associates Consulting Services LLC filed a lawsuit in Fayette County Circuit Court on Aug. 29 against Roaring River Community Association Inc., Marcel Demarteau, president of Roaring River, and John Herlihy, past president of Roaring River, citing breach of contract and tortious interference with contractual relations.
According to the complaint, on Feb. 27, 2009, EK entered into a contract with Roaring River to provide consulting services to the association and its lot owners.
The complaint states that during a period between April 1, 2010, and March 31, 2012, EK continued to provide Roaring River with such services at the request of Roaring River's president. EK alleges that as a result of the services rendered, Roaring River owes EK $75,092 plus interest for failure to pay from May 2010 through April 30, 2012.
EK & Associates is seeking $75,092 in actual damages, an undisclosed amount of compensatory damages, plus legal fees and court costs. They are being represented in the case by Oak Hill attorney Philip J. Tissue.
