Woman's estate sues State Auto Insurance in Jackson County

RIPLEY - A woman's estate is seeking underinsured motorist coverage benefits after she died in a car crash.

The Estate of Ashley Nicole Burdette, by Oather Burdette and James W. Deitz, co-administrators, filed a lawsuit Aug. 2 in the Circuit Court of Jackson County against State Auto Property and Casualty Insurance Company and Anna Deitz.

According to the complaint, on Aug. 4, 2011, Anna Deitz was operating a 2007 Chevy Cobalt when she ran off the road and struck a tree, killing her passenger Ashley Nicole Burdette.

After the collision, James Deitz notified his insurance company of a claim for underinsured motorist coverage to recover $20,000, which he alleges is owed under the insurance contract.

The estate is seeking damages in the amount of the State Auto policy liability limits of underinsured motorist coverage, plus attorney's fees and court costs. They are being represented by Kevin C. Harris and Eric J. Holmes of the Law Offices of Harris & Holmes PLLC.
