Slip-and-fall filed against Walmart

HUNTINGTON - A woman is suing Wal-Mart Stores East LP for injuries she allegedly sustained while in one of its stores.

Wal-Mart Stores East is doing business as Walmart Supercenter.

John Doe, unknown person or persons, was also named as a defendant in the suit.

On Sept. 1, 2012, Lynette Eplin was grocery shopping at Walmart when she slipped and fell as a result of liquid on the floor, according to a complaint filed Sept. 24 in Cabell Circuit Court.

Eplin claims the defendant owed her a duty to maintain its premises in a reasonably safe condition and breached its duty.

At the time of the incident, Walmart was negligent and careless in the maintenance of the area in failing to take appropriate measures to ensure that the area was properly inspected and maintained in a reasonably safe condition; in failing to warn the public of the danger posed by the spilled liquid; and other acts of negligence, according to the suit.

Eplin claims as a result of the incident, she suffered extreme physical and mental pain and suffering.

Eplin is seeking compensatory damages. She is being represented by Matthew J. Woelfel and Michael A. Woelfel of Woelfel & Woelfel LLP.

The case has been assigned to Circuit Judge F. Jane Hustead.
