HUNTINGTON - A former employee says Fahey Exteriors LLC allowed him to work in an unsafe working condition that caused him injuries.

On Sept. 22, 2011, Elisha Bartram was employed as a roofer by Fahey and was instructed to engage and/or work in an unsafe, improper and dangerous condition and/or caused him to operate and work around defective, improper and/or inadequate tools and/or equipment and/or training and supervision, knowing that the employment activities were unsafe, according to a complaint filed Sept. 19 in Cabell Circuit Court.

Bartram claims he was exposed and suffered serious compensable injuries.

As a result of the defendant's negligence, Bartram suffered physical and mental pain and suffering; loss of enjoyment of life; loss of capacity to earn an income; medical expenses; and annoyance, inconvenience, embarrassment and humiliation, according to the suit.

Bartram is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Kenneth P. Hicks of Kenneth P. Hicks LC.
