Slip-and-fall lawsuit against Family Dollar settled

CHARLESTON - A lawsuit against Family Dollar has been settled dismissed from Kanawha Circuit Court.

The plaintiff and the defendants announced to the Court that all matters in controversies regarding this action have been agreed, compromised and settled, according to a Final Dismissal Order filed Dec. 11 in Kanawha Circuit Court.

On July 23, 2009, Karen Harper was shopping in the Family Dollar in Dunbar when she slipped and fell and was injured, according to a complaint filed July 22, 2011, in Kanawha Circuit Court.

Harper claims there were no warning signs posted within the proximity of the slippery substance, which she believes was liquid soap.

The manager, employees and/or store operator knew or should have known of the slippery substance in the floor, according to the suit.

Harper claims the defendant failed to clean up the floor.

Harper was seeking compensatory damages with pre- and post-judgment interest. She was represented by Maggie K. Wall and G. Wayne Van Bibber of the Law Offices of G. Wayne Van Bibber & Assoc. PLLC.

The defendant was represented by Jason S. Hammond and Josef A. Horter of Bailey & Wyant PLLC.

The case was assigned to Circuit Judge Louis H. Bloom.
