CHARLESTON - A woman is suing OSI Limited Liability Company for injuries she allegedly sustained while on its property.
One Stop Inc. and One Stop were also named as defendants in the suit.
On Feb. 10, 2012, Annette Joyce Doumany left the One Stop entrance and proceeded toward her vehicle to pump gas into her car, according to a complaint filed Sept. 9 in Kanawha Circuit Court.
Doumany claims while on the property, she tripped over a hole in the concrete/uneven pavement and fell.
Due to the fall, Doumany suffered significant bodily injury, including a right humerus fracture and right knee contusion, according to the suit.
Doumany claims the defendants failed to warn her of any hazardous conditions, to inspect its premises, to prevent hazardous or unusual conditions to exist, to repair or make safe any hazardous or unusual conditions and to promptly notify the public of any hazardous or unusual conditions at One Stop.
As a direct and proximate result of the defendants' negligence and/or carelessness, Doumany suffered and continues to suffer severe physical and mental pain and anguish, according to the suit.
Doumany claims she suffered pain of body and mind and was prevented from engaging in normal daily activities and loss of her good health and enjoyment of life.
The defendants caused Doumany to incur diverse and sundry expenses for doctors, hospitals, surgery, physical therapy, medicines and other medical care and attention, according to the suit.
Doumany is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Tim C. Carrico of Carrico Law Offices LC.
The case has been assigned to Circuit Judge James C. Stucky.
