BECKLEY – A wrongful death settlement with a Beckley nursing home appears to be worth $75,000.
On Feb. 25, Bonnie Rakes, as the administratrix of the Estate of Lottie Duncan, filed a petition to approve a settlement reached with Sunbridge Beckley Health Care Corp., doing business as Pine Lodge Care and Rehabilitation Center.
The petition asked Raleigh County Circuit Court Judge H.L. Kirkpatrick to approve a $75,000 settlement.
However, Kirkpatrick’s final order approving the settlement was filed under seal.
Duncan was a resident of Pine Lodge from Feb. 14, 2011, to May 23, 2011, the petition says. She passed away on May 30.
The petition asked for three payments of $25,000 in November, December and January.
The estate was represented by Douglas A. Spencer of the Charleston firm Hill, Peterson, Carper, Bee & Deitzler and M. Chad Trammell of The Trammell Law Firm. They requested one-third of the settlement - $25,000 – and another $5,000 in expenses.
