BECKLEY - A Raleigh County couple are suing a doctor after multiple knee surgeries allegedly resulted in more damage.

Donald Anderson and Sarah Anderson filed a lawsuit July 17 against Matthew K. Nelson M.D. in the Circuit Court of Raleigh County, citing medical malpractice.

Donald Anderson says that on Sept. 19, 2011, he underwent right knee arthroplasty that was performed by Dr. Matthew K. Nelson at Raleigh General Hospital.

According to the complaint, on Oct. 18, 2011, Anderson underwent a right total knee arthroplasty manipulation, again performed by Dr. Nelson. Following the second surgery, on Nov. 10, 2011, Anderson says he went to a follow up with Dr. Nelson at which time Dr. Nelson noted swelling from the right knee to the ankle.

Dr. Nelson performed a second procedure on Anderson's knee on Nov. 11, 2011, when he noted that Anderson had a grade 2 fracture ulcer on the site of the incision, the suit says.

According to the complaint, between Nov. 11, 2011, and Feb. 29, 2012, Anderson underwent repeated procedures on his right leg performed by Dr. Nelson. On Feb. 27, 2012, Anderson transferred his care to Dr. Brock Lindsey at West Virginia University Hospital, he says.

Upon examination, Lindsey allegedly noted that Anderson's knee was stuck in a flex position with no active extension and with a chronically draining wound. According to the complaint, Anderson has undergone four additional surgeries to fix his condition and still suffers from permanent injury to his knee.

The Andersons are seeking damages in excess of the jurisdictional limit. They are being represented in the case by attorneys Robert V. Berthold, Jr. and Christina L. Smith of Berthold Law Firm PLLC.
