CHARLESTON - A man is suing Petroleum Transport LLC after he claims it discriminated against him.
Glenn Summers was also named as a defendant in the suit.
Henry J. Briefs was employed by the defendants from May 2, 2008, until April 12, 2012, according to a complaint filed Sept. 10 in Kanawha Circuit Court.
Briefs claims during the course of his employment, he consistently performed his duties in a satisfactory manner, met the reasonable expectations of the defendants and was not administered any written warnings.
From Sept. 15, 2011, until Jan. 15, 2012, Briefs was off work for four months due to a compensable Workers' Compensation injury to his left shoulder, as he had a torn rotator cuff, according to the suit.
Briefs claims despite being very injured, he continued to work for the defendants and, after following up with providers, he began getting harassed by the defendants.
The defendants refused to provide Briefs with an accommodation of modified duty and violated the West Virginia Human Rights Act, according to the suit.
Briefs is seeking compensatory damages with pre- and post-judgment interest. He is being represented by D. Adrian Hoosier II of the Hoosier Law Firm PLLC.
The case has been assigned to Circuit Judge Carrie Webster.
