Plastic surgeon sued over breast reduction surgery

PINEVILLE - A couple are suing after a doctor allegedly failed to exercise the standard duty of care during breast reduction surgery.

Eleanora Burks and Larry Burks filed a lawsuit Sept. 25 against Abdalla Z. Bandak, individually and doing business as Bandak Plastic Surgery PLLC, citing medical malpractice negligence and loss of consortium.

According to the complaint, on July 18, 2011, Eleanora Burks had a breast reduction procedure performed by Dr. Bandak.

The complaint alleges that on the way home after surgery, her breast started turning black and she contacted Dr. Bandak who informed her to watch it. According to Burks, about a month later she had a second surgery performed by Dr. Bandak at which time he removed her nipple.

Burks alleges that she was not fully put to sleep for the procedure and could feel Bandak tearing the nipple off and draining it. She further states that since November 2011 she has had numbness in her neck.

Burks says that on Sept. 4, 2011, she went to Raleigh General Hospital and was given antibiotics for what appeared to be an infection as a result of the surgery and treatment after the surgery performed by Dr. Bandak.

Burks is seeking damages in accordance with the West Virginia Professional Liabilities Act. She is being represented in the case by Beckley attorney Michael E. Froble.
