Couple sue Keyser Walmart, alleges wife tripped on pole

KEYSER - Shirley R. Vinci and Raymond E. Vinci filed suit in the Mineral County Circuit Court on Sept. 24, naming Walmart as defendant.

According to the Vincis, Wal-Mart is responsible for Shirley Vinci's personal injuries. Shirley Vinci claims she was walking in the grocery section of the Walmart at U.S. Route 220 in Keyser when she tripped on a pole protruding from the ground and fell.

Shirley Vinci is alleging there was a four-to-five-foot rounded metal pole sticking up from the ground that presented a dangerous condition.

The Vincis are claiming Walmart knew or should have known the pole created a hazardous condition and was negligent in allowing it to exist. Shirley Vinci alleges she tripped and fell on the pole, sustaining injuries to her entire body requiring her to expend sums of money in medical treatment.

The Vincis are suing for negligence as well as loss of consortium.

Vinci is seeking more than $50,000 in damages. She is being represented by Maryland attorney Bruce A. Kirkwood.
